How we handle the file
We start with a search for similar registered and pending marks to gauge the chances of acceptance before fees are paid, then identify the right classes for the goods or services. We file the application with the Saudi Authority for Intellectual Property under the GCC Trademark Law and its Implementing Regulations, and follow examination, publication and any opposition through to registration. In infringement cases we document the infringement, send a warning letter where appropriate, and then take action before the Authority or the competent court, depending on the right involved.
Common questions
Does my commercial registration protect my business name as a trademark?
No. A commercial registration and trade name are not a substitute for registering the trademark. Trademark protection depends on registration with the Saudi Authority for Intellectual Property in the classes where the mark is used, so it is sensible to register before investing heavily in the name or logo.
My trademark is registered in another country. Do I need to register it in Saudi Arabia?
Trademark protection is territorial, so registration abroad does not usually give full protection in the Kingdom. Special rules may apply to well-known marks, but they have to be proved, and registering in Saudi Arabia remains the clearest route.
I have found a product using a mark similar to mine. What should I do?
Start by documenting the infringement with photos, invoices, links and dates, then assess how similar the marks are and how likely consumers are to be confused. Depending on the outcome, a warning letter may be enough, or action may be needed before the Authority or the competent court.
